Playboy model Dani Mathers could face prosecution for posting the photo of that naked woman after TMZ reports, investigators have tracked down the victim who is willing to testify against Mathers.
The victim is reportedly a woman in her 70s and according to TMZ, she wants Mathers to feel the, “full force of the law.”
Mather’s posted a photo of the naked woman in July to her Snapchat with the caption, “If I can’t unseen this, then you can’t either.”
The woman was undressing in the shower of an LA Fitness gym.
The internet erupted in anger over Mathers post with many accusing her of body shaming the victim.
Mather’s took to social media to apologize saying, she was new to Snapchat and the photo, which was meant as a private message to a friend, was accidentally shared publicly.
Despite her apology, the case has been turned over the city attorney’s office where prosecutors could file charges.
“This playmate is going to be facing criminal charges for a ‘Peeping Tom’ statute,” Leo Terrell, Civil Rights Attorney, said. “You can’t video tape someone who is partially nude without their consent on private property, she could face jail time six months to a year. Civilly, she better have deep pockets because that type of infliction of emotional distress can cost this playmate thousands of dollars.”
Mather’s attorney Tom Meserau responded to the reports with this statement, "I hope she is not charged. Dani Mathers never tried to hurt anyone at anytime and she certainly never intended to break the law."
No charges have been filed at this time.
The city attorney’s office said the case is under review.
