Kidnapping suspect fights for custody of kids

TAMPA (FOX 13) - In March, Trevor Summers decided to write a suicide note to his five kids. He apologized for heading down the road of divorce and said goodbye to his children.  

Police say just hours earlier, he had kidnapped and raped his estranged wife Alicia and planned a murder-suicide.  But detectives got a tip and thwarted the deadly plot.

That was three months ago.  Now Trevor is getting ready to go to trial.  While he fights kidnapping, rape, and attempted murder charges, he is also locked in a custody battle.

Their five kids are in the custody of the state, according to court records. Alicia is fighting for full custody, but so is Trevor and his family.

Monday in court, his public defender requested all documents and audio recordings related to the custody issue.

The judge granted the request. The hearings have been closed to the media, so details of the dispute are not available to the public.

When the kidnapping occurred, police say, Alicia shared custody of her kids with Trevor.  Now it's a tug of war for the children and until the issue is resolved, all five kids will remain in limbo. 

Trevor's trial is set for August.
